These Terms and Conditions govern the use of the CAD4x4.com website and all services and digital products offered through it.

By accessing this website, you confirm that you accept these Terms and Conditions in full. Do not continue to use the website if you do not accept all of the terms stated here.

1. Terminology

In this document:

  • “Client”, “You”, “Your” refers to the person accessing this website and accepting the Company’s Terms and Conditions.

  • “The Company”, “We”, “Us”, “Our” refers to CoverXtreme Bartłomiej Sakowicz.

  • “Party”, “Parties” refers to both the Client and the Company.

  • “Project” means a set of digital technical files (DWG, DXF, PDF or similar) provided in a ZIP archive, enabling the Client to manufacture a physical off-road product.

All terms refer to the agreement between the Client and CoverXtreme for the sale of digital technical documentation (e.g. CAD/DXF/DWG/PDF files) for fabrication of off-road vehicle parts, intended for personal and commercial use files, in accordance with Polish law.

Note: All products sold through this website are digital technical files intended for self-fabrication of parts. We do not sell ready-made or physical products.

2. Transaction Terms & Conditions

By clicking “I accept” and purchasing a project, you as a Client:

  • accept full responsibility for the design, construction, safety, and appearance of the physical product you create using the purchased project files,

  • accept full liability for any damage, injury, or death resulting from the use or misuse of the constructed product,

  • may modify the files at your own risk, but any modified version remains subject to the original license terms. Modifying a project does not grant rights to distribute, reproduce, or sell multiple copies unless expressly permitted.,

  • are responsible for the proper construction quality and structural durability of the final product,

  • agree to use the project to fabricate one (1) physical product per license,
    • you may use the resulting product for personal or commercial purposes, including resale,
    • further reproduction or use of the files to produce multiple units requires the purchase of additional licenses or a commercial agreement.

  • acknowledge that due to the digital nature of the product, and in accordance with Article 38(13) of the Polish Consumer Rights Act, the right to withdraw from the contract does not apply once the file download begins.

3. Our Commitments

As cad4x4 // CoverXtreme, we will:

  • deliver within 2 business days a ZIP file containing:

    1. a 2D DWG file – for CNC preparation, files are compatible with AutoCAD 2010 and newer ,

    1. a 3D DWG file – to illustrate bending angles and final appearance, files are compatible with AutoCAD 2010 and newer,

3 where applicable, additional files (e.g. PDF drawings, documentation of welds, bend lines, angle data, fastener positions, or assembly details) may be included. The specific content and formats of such supplementary files are listed individually in each product’s description.

    1. All project documentation and file descriptions are provided in English unless otherwise specified in the product listing.

  • respond to inquiries about the execution of purchased projects at: shop@cad4x4.com,

  • provide only original, self-developed projects (no copies of third-party designs),

  • test and assemble every project internally before it is offered for sale. Projects are published only if no issues are found during assembly,

  • projects are not certified, CE-marked, or approved for road use under any formal regulatory framework.

  • all projects are assembled and evaluated in practical off-road conditions, but are not subject to formal certification or laboratory testing ,

  • ensure that each project is prepared with attention to technical accuracy and visual quality,

  • use personal data only for order fulfillment purposes (delivery of files and legal sale contract). Data will not be sold or shared with third parties not involved in the transaction,

  • apply technical and organizational safeguards to protect customer data,

  • grant each user the right to access, rectify, or delete their personal data in compliance with applicable data protection laws. The data controller is: CoverXtreme, ul. Oliwska 59a, Chwaszczyno, Poland.

  • the Company disclaims any responsibility for damages, injuries, or legal consequences resulting from the fabrication or use of products made from these files. You accept full responsibility for verifying structural integrity and legal compliance in your jurisdiction

Important:
The purchased digital file cannot be returned. We are unable to verify whether it has been used, copied, or stored. By initiating the download, you consent to the immediate performance of the contract and acknowledge the loss of your right of withdrawal under Article 38(13) of the Polish Consumer Rights Act.

4. Cookies

We employ the use of cookies. By using CoverXtreme's website you consent to the use of cookies in accordance with CoverXtreme’s privacy policy. We use cookies to enhance user experience and analyze website traffic. By continuing to use this site, you agree to our use of cookies in accordance with our [Privacy Policy]. Unless otherwise stated, all intellectual property rights in the materials on this website belong to CoverXtreme and/or its licensors.

You may view and/or print content from http://cad4x4.com for personal or limited commercial use (one licensed product per purchase), subject to the following restrictions:

You must not:

  • republish material from cad4x4.com,

  • sell, rent, or sub-license project files, even when you made new files based on purchased files

  • reproduce, duplicate, or copy content,

  • You may modify the files for your own use (personal or resale of one physical item), but you must not reverse-engineer or extract design elements in order to create derivative works, new products, or multiple units without a separate license or agreement.

One license allows for the creation of one (1) physical item. For multiple units, separate licenses must be acquired or a commercial agreement must be signed.

Redistribution is not allowed unless content is explicitly marked as available for redistribution.

Commercial Use Clause
Each file purchase grants the right to manufacture one (1) physical product intended for sale or commercial use. For additional units, a new license must be purchased per unit, or a separate commercial license agreement must be signed. File redistribution, duplication, or mass production from a single license is strictly prohibited. Use of the files for automated or batch production using CNC machines or similar means is not allowed unless a commercial agreement has been signed.

6. Linking to Our Website

You may link to our website if the link:

  • is not misleading,

  • does not falsely imply sponsorship or endorsement,

  • fits the context of your own content.

We reserve the right to request removal of any link at any time.

Deep linking (direct linking to downloadable files bypassing our website structure) is strictly prohibited.

If you represent an organization and wish to link to our site, please contact us at shop@cad4x4.com with:

  • your organization name,

  • contact details,

  • URLs that will link to our site,

  • and the specific page(s) on our site you want to link to.

Use of our name, logo, or any visual identity elements for linking, advertising, or promotion is strictly prohibited without our prior written consent.

9. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of Poland. The competent court shall be the court appropriate for the registered office of the Company, unless mandatory law states otherwise.

In the event of disputes, the Polish version of these Terms shall prevail. Jurisdiction: District Court in Kartuzy (Sąd Rejonowy w Kartuzach).

We reserve the right to update these Terms and Conditions at any time. Continued use of the website and services following such updates constitutes acceptance of the revised terms.

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior discussions, agreements, or representations regarding the use of our services and products.

Niniejszy Regulamin określa zasady korzystania ze strony internetowej CoverXtreme oraz wszystkich usług i produktów cyfrowych dostępnych za jej pośrednictwem.

Korzystając z tej strony internetowej, potwierdzasz, że w pełni akceptujesz niniejszy Regulamin. Nie korzystaj z witryny, jeśli nie zgadzasz się z którymkolwiek z jego postanowień.

1. Terminologia

W niniejszym dokumencie:
• „Klient”, „Ty”, „Twój” odnosi się do osoby korzystającej z witryny i akceptującej Regulamin.
• „Firma”, „My”, „Nas”, „Nasz” odnosi się do CoverXtreme Bartłomiej Sakowicz.
• „Strony” oznacza zarówno Klienta, jak i Firmę.
• „Projekt” oznacza zestaw cyfrowych plików technicznych (DWG, DXF, PDF lub podobnych) dostarczanych w archiwum ZIP, umożliwiających Klientowi wykonanie fizycznego produktu off-road.

Wszystkie postanowienia dotyczą umowy między Klientem a CoverXtreme dotyczącej sprzedaży cyfrowej dokumentacji technicznej (np. plików CAD/DXF/DWG/PDF) przeznaczonej do wykonania części do pojazdów off-road na użytek własny lub komercyjny, zgodnie z prawem polskim.

Uwaga: Wszystkie produkty oferowane na tej stronie to pliki cyfrowe przeznaczone do samodzielnego wykonania części. Nie sprzedajemy gotowych ani fizycznych produktów.

2. Warunki transakcji

Klikając „Akceptuję” i dokonując zakupu projektu, jako Klient:
• przyjmujesz pełną odpowiedzialność za projekt, wykonanie, bezpieczeństwo i wygląd fizycznego produktu stworzonego na podstawie zakupionych plików,
• ponosisz pełną odpowiedzialność za wszelkie szkody, urazy lub śmierć wynikające z użycia lub niewłaściwego użycia wykonanego produktu,
• możesz modyfikować pliki na własne ryzyko, ale zmodyfikowana wersja nadal podlega pierwotnym warunkom licencji. Modyfikacja nie daje prawa do dystrybucji, powielania ani sprzedaży wielu kopii bez wyraźnego zezwolenia,
• odpowiadasz za jakość wykonania i trwałość konstrukcji,
• zgadzasz się na wykorzystanie projektu do wykonania jednego (1) fizycznego produktu na każdą zakupioną licencję,
• możesz wykorzystać wykonany produkt na własny użytek lub do dalszej odsprzedaży,
• dalsze kopiowanie lub wykorzystanie plików do produkcji wielu egzemplarzy wymaga zakupu dodatkowych licencji lub zawarcia osobnej umowy komercyjnej,
• przyjmujesz do wiadomości, że ze względu na cyfrowy charakter produktu, zgodnie z art. 38 pkt 13 ustawy o prawach konsumenta, prawo do odstąpienia od umowy nie przysługuje po rozpoczęciu pobierania plików.

3. Zobowiązania firmy

Jako cad4x4 // CoverXtreme zobowiązujemy się:
• dostarczyć w ciągu 2 dni roboczych plik ZIP zawierający:

  1. plik 2D DWG – do przygotowania pod CNC (kompatybilny z AutoCAD 2010 i nowszym),

  2. plik 3D DWG – ilustrujący kąty gięcia i finalny wygląd (kompatybilny z AutoCAD 2010 i nowszym),

  3. (opcjonalnie) dodatkowe pliki: rysunki PDF, dokumentacja spoin, linie gięcia, dane kątów, rozmieszczenie śrub lub detale montażowe – ich obecność i format są wyszczególnione w opisie każdego produktu,
    • dostarczyć dokumentację i opisy w języku angielskim (chyba że opis produktu stanowi inaczej),
    • odpowiadać na zapytania dotyczące realizacji projektów pod adresem: shop@cad4x4.com,
    • oferować wyłącznie oryginalne projekty stworzone we własnym zakresie (bez kopiowania cudzych rozwiązań),
    • każdy projekt jest testowany i składany przed wprowadzeniem do sprzedaży – publikowane są tylko te, które nie sprawiają problemów podczas montażu,
    • projekty nie posiadają certyfikatów, oznaczenia CE ani dopuszczeń drogowych,
    • projekty są sprawdzane w praktycznych warunkach off-road, ale nie przechodzą certyfikacji laboratoryjnej,
    • dbać o dokładność techniczną i estetykę projektów,
    • przetwarzać dane osobowe wyłącznie w celu realizacji zamówienia – nie sprzedajemy i nie udostępniamy danych podmiotom niezaangażowanym w transakcję,
    • stosować środki techniczne i organizacyjne chroniące dane osobowe,
    • zapewnić dostęp, możliwość sprostowania i usunięcia danych osobowych zgodnie z przepisami RODO. Administratorem danych jest CoverXtreme, ul. Oliwska 59a, Chwaszczyno, Polska,
    • Firma nie ponosi odpowiedzialności za szkody, urazy ani skutki prawne wynikające z wykorzystania lub wykonania produktów na podstawie naszych plików. Klient samodzielnie odpowiada za zgodność z prawem i wytrzymałość konstrukcji w swoim kraju.

Ważne:
Zakupionego pliku cyfrowego nie można zwrócić – nie mamy możliwości potwierdzenia, czy został użyty, skopiowany lub zapisany. Rozpoczęcie pobierania oznacza zgodę na natychmiastową realizację umowy i utratę prawa do odstąpienia na mocy art. 38 pkt 13 ustawy o prawach konsumenta.

4. Pliki cookies

Korzystamy z plików cookies. Korzystając z serwisu CoverXtreme, wyrażasz zgodę na stosowanie cookies zgodnie z naszą Polityką Prywatności.
Cookies używane są w celu poprawy funkcjonalności strony i analizy ruchu. Niektóre funkcje mogą nie działać bez nich. Mogą być również używane przez naszych partnerów afiliacyjnych lub reklamowych.

Nie wolno:
• publikować ponownie materiałów z cad4x4.com,
• sprzedawać, wynajmować ani sublicencjonować plików projektowych – nawet zmodyfikowanych,
• kopiować ani powielać treści,
• modyfikować plików w celu tworzenia nowych produktów, dzieł pochodnych lub produkcji seryjnej – bez odrębnej licencji lub umowy,

Jedna licencja uprawnia do wykonania jednego (1) fizycznego egzemplarza. Produkcja seryjna lub automatyczna (np. CNC) wymaga podpisania osobnej umowy komercyjnej.

Zastrzeżenie dla zastosowania komercyjnego:
Każdy zakup uprawnia do wykonania jednego produktu przeznaczonego na sprzedaż lub użytek komercyjny. Produkcja kolejnych egzemplarzy wymaga zakupu dodatkowych licencji lub zawarcia umowy komercyjnej. Powielanie, masowa produkcja lub automatyzacja na podstawie jednej licencji są zabronione.

6. Linkowanie do naszej strony

Dozwolone jest linkowanie do naszej strony pod warunkiem, że:
• link nie wprowadza w błąd,
• nie sugeruje poparcia lub sponsorowania,
• pasuje kontekstowo do treści strony linkującej.

Zastrzegamy sobie prawo do żądania usunięcia dowolnego linku.

9. Prawo właściwe

Regulamin podlega prawu polskiemu. Właściwym sądem jest sąd właściwy dla siedziby firmy, o ile bezwzględnie obowiązujące przepisy nie stanowią inaczej.

W przypadku sporów rozstrzygająca jest wersja polska niniejszego regulaminu.
Właściwy sąd: Sąd Rejonowy w Kartuzach.

Zastrzegamy sobie prawo do wprowadzania zmian w Regulaminie. Dalsze korzystanie z witryny oznacza akceptację nowych warunków.

Niniejszy Regulamin stanowi całość porozumienia między Stronami i zastępuje wszelkie wcześniejsze ustalenia ustne lub pisemne dotyczące korzystania z naszych usług i produktów.
